اجراءات التسجيل في القائمة الانتخابية في ظل الأمر 21-01

الملخص
تعد عملية التسجيل بالقائمة الانتخابية الحلقة الأساسية للعملية الانتخابية باعتبار أن التسجيل هو الدليل على اكتساب المواطن صفة الناخب، ولاكتساب هذه الصفة بالطريقة القانونية نظم الأمر 21-01 المتعلق بنظام الانتخابات هذه العملية من خلال وضع شروط وموانع لتسجيل بالقائمة الانتخابية وتحديد اللجنة المكلفة بالتسجيل والجهة المختصة بالفصل في الاعتراضات وطعون المتعلقة بهذه المرحلة. إن الهدف من الدراسة يكمن في تحديد أهم التعديلات المتعلقة بمرحلة التسجيل في القوائم الانتخابية طبقا للأمر 21-01 المتعلق بنظام الانتخابات. وتتمثل أهمية الدراسة في تحديد أهم الإجراءات الواجب إتباعها من طرف المواطن لإكتساب صفة الناخب المحددة بموجب الأمر 21-01 المتعلق بنظام الانتخابات. أهم النتائج المتوصل إليها من خلال هذه الدراسة: - ضرورة التوسيع من نطاق الموطن الانتخابي لتسهيل مباشرة التسجيل من طرف الناخب . - إن وضع عقوبة ردعية على كل من لم يسجل نفسه في القائمة الانتخابية يضفي نوعا من الإلزامية على واجب التسجيل. Abstract: The process of registration in the electoral list is the basic of the electoral process, given that registration is evidence of a citizen's acquisition of the voter status, and to acquire this capacity by the legal method, Ordinance 21-01 organized this process by setting conditions and impediments to registration in the electoral list and specifying the committee in charge of registration and the competent authority to adjudicate objections and appeals. Related to this stage. The aim of the study is to determine the most important amendments related to the registration stage in the electoral list in accordance with Order 21-01. The importance of the study is to determine the most important procedures that must e followed y the citizen to acquire the voter status specified under Ordinance 21-01 related to the electoral system. The most important results: - Restricting the determination of the electoral domicile according to the concept of civil domicile. - The obligation to register on the electoral list is voluntary, based on a request form the citizen.
