التكريس الدولي لهيمنة سيداو على القوانين الوطنية

الملخص
خلافا لما يعتقده كثير من الباحثين، من كون الأثر الذي يتبع التوقيع على اتفاقية سيداو CEDAW متعلقا بقانون الأسرة فقط، فإن التوقيع عليها ممتد أثره إلى كل مجالات الحياة الاجتماعية والاقتصادية، والسياسية والتشريعية. ذلك أن اتفاقية سيداو أتت بكليات القصد منها إعادة صياغة الدساتير والتشريعات، وإعادة برمجة أولويات الإنسان، وفق رؤية لا تعترف بالدين الإسلامي، وتختزل موروثاته على مر السنين. إذ مما تحرص عليه الاتفاقية، ولا تقبل التنازل عنه أنْ لا دين ولا عادة، ولا موروث آخر مهما كانت قدسيته يقف دون التنفيذ الكامل لمبدأ المساواة المطلقة. واستطاع القائمون عليها تنفيذ بنودها وفق رؤية إستراتيجية. استمدت هذه الرؤية قوتها من النظرة الدقيقة أفقيا وعموديا، قائمة على استيعاب شبكة توزيع الأدوار بين المؤسسات من أعلاها إلى أدناها، بدءا من المؤسسات الدولية، ومرورا بالحكومية إلى المنظمات، إلى الجمعيات الموزعة في الأقاليم الصغرى والأحياء. وحتى تكتمل الفكرة، حاولت إيراد شيء مما يتعلق بالالتزامات الجزائرية تجاه اتفاقية سيداو، ومبلغ أثرها في التشريع والمجتمع. Abstract: Contrary to what many researchers believe, that the effect that follows the signing of the cedaw is related to family law only, the signing of it extends its impact to all areas of social, economic, political and legislative life. This is because the CEDAW agreement brought in faculties intended to reformulate constitutions and legislation, and reprogram human priorities according to a vision that does not recognize the Islamic religion, and reduces its legacies over the years. Because of what the agreement is keen on, and does not accept to waive, that there is no religion, tradition, and other heritage, regardless of its sanctity, that stands without the full implementation of the principle of absolute equality. Those responsible were able to implement its provisions according to a strategic vision. This vision derived its strength from the accurate view, both horizontally and vertically, based on understanding the network of roles distribution between institutions from the highest to the lowest, starting from international institutions, passing through government to organizations, to associations distributed in smaller regions and neighborhoods. To complete the idea, I tried to list something related to the Algerian obligations towards CEDAW, and the amount of its impact on legislation and society. key words: Restriction; CEDAW; Family law; Constitutions; Ligislations.
