تفعيل دور القاضي الأسري في حماية الأسرة بين الصلاحيات والمعوقات

الملخص
أراد المشرع الجزائري من خلال تعديله لقانوني الأسرة والإجراءات المدنية والإدارية أن يقوم قضاء شؤون الأسرة بدوره على أكمل وجه في التطبيق السليم لمقتضيات قانون الأسرة، حيث خول له سلطة تقديرية واسعة يتأتى من خلالها مراعاة ظروف كل قضية على حدة، وتحقيق العدل بين كافة أفراد الأسرة والحرص على المصالحة بينهم ليعتبر القاضي حكما يمكنه إصلاح ذات البين وبتر كل أسباب الخلاف بين الزوجين وتقصي مصلحة الطفل ومراعاة حقوقه بالإسراع في البت في كل ما يحقق ذلك. ورغبة من المشرع الجزائري في تفعيل دور القضاء في حماية الأسرة ارتأى توسيع الدور المنوط بالنيابة في هذا النوع من القضايا، لذلك سنكشف من خلال هذه الورقة البحثية مدى توفيق المشرع الجزائري في تحقيق ما أراده ، مع الوقوف عند العقبات التي يمكن أن تعترض قاضي شؤون الأسرة في بلوغ ذلك، وكيف السبيل إلى تجاوزها للوصول به لممارسة صلاحياته بشكل أكثر فعالية. The Algerian legislator, through amending the family law and civil and administrative procedures, wanted the family affairs judiciary to play its role fully in the proper implementation of the requirements of the family law, as it has been empowered with wide discretionary power through which to take into account the circumstances of each case separately, and to achieve justice among all family members To reconcile between them so that the judge considers an arbitrator who can reconcile the differences between the spouses, investigate the interests of the child, take into account his rights, and expedite the decision on everything that achieves this, Desiring the Algerian legislator to activate the role of the judiciary in protecting the family, he decided to expand the role assigned to the prosecution in this type of case. That is, through this research paper, we will reveal the extent of the success of the Algerian legislator in achieving what he wants, while standing at the obstacles that may be encountered by the family affairs judge in Achieving this, and how to overcome it in order for him exercise his powers.
