الملخص
تهدف هذه الورقة البحثية دراسة الشرط الجزائي في عقد الاعتماد الإيجاري في ظل التشريع الجزائري، لاسيما الأمر رقم 96 -09 والذي يعتبر من أهم الضمانات الذي يدرجه المؤجر ضمانا لحسن تنفيذ العقد. إلا أنه قد يكون هذا الشرط مبالغا فيه، مما يتيح للقاضي سلطة تعديله طبقا لأحكام الأمر السالف الذكر، وكذا طبقا للقواعد العامة من أجل خلق توازنات بين أطرافه. Abstract: This paper aims to examine the penalty clause in the contract of rent credit under Algerian legislation, in particular Decree No. 96-09 which is one of the most important guarantees listed by the lessor for the proper execution of the contract. However, this requirement may be exaggerated, allowing the judge to amend it in accordance with the provisions of the above-mentioned order, as well as in accordance with the general rules, in order to create balance between the parties.
