الخصوصيات الثقافية بين عولمة وعالمية حقوق الإنسان Cultural Peculiarities Between Globalization And Universality Of Human Rights

الملخص

تسعى هذه الدراسة إلقاء الضوء على المكانة القانونية التي تحظى بها الخصوصيات الثقافية للشعوب في ظل القانون الدولي لحقوق الإنسان، و مدى تأثير كل من العالمية و العولمة في تعزيز و ضمان حمايتها سواء على المستوى الدولي أم الإقليمي، أم الوطني. حيث أنه، و منذ تدويل حقوق الإنسان تزايد التساؤل حول حق الشعوب في الحفاظ على خصوصياتها الثقافية، للتأكيد على عالمية حقوق الإنسان، و إمكانية تحقيقها دون تمييز لغوي، أو ديني، أو إثني ...إلخ ، في عصر تغلُب عليه العولمة، و الهيمنة الثقافية للدول الغربية على الخصوص. و في ظل هذه المعادلة الصعبة بين عالمية حقوق الإنسان و الخصوصيات الثقافية التي تستوجب احترامها، و حمايتها للحفاظ على استقرار و أمن هذه الشعوب من جهة، و بين عولمة حقوق الإنسان التي ينادي بها البعض، ليكون العالم قرية كونية واحدة لا تعرف الحدود و لا تعترف بأي خصوصية من جهة أخرى، و عليه تهدف هذه الدراسة إلى الوصول إلى موازنة بين متغيرات هذه المعادلة، لتحقيق الحماية اللازمة للخصوصيات الثقافية للشعوب المختلفة. This study looks to shed light on the legal status of peoples' cultural peculiarities under international human rights law, and the extent of the influence of globalization and globalization in promoting and ensuring their protection, whether at the international, regional, or national levels. While, since the internationalization of human rights, there has been an increasing question about the right of peoples to preserve their cultural peculiarities, to emphasize the universality of human rights, and the possibility of achieving them without linguistic, religious, or ethnic discrimination ... etc., in an era dominated by globalization and domination Cultural for Western countries in particular. In light of this difficult equation between the universality of human rights and the cultural specificities that must be respected and protected to maintain the stability and security of these peoples on the one hand, and between the globalization of human rights advocated by some, so that the world becomes a single global village that knows no boundaries and does not recognize Any specificity on the other hand, and therefore this study aims to reach a balance between the variables of this equation, to achieve the necessary protection for the cultural peculiarities of different peoples.
