الملخص
حصر المؤسس الدستوري بموجب أحكام المادة 104 من التعديل الدستوري 2016 حالة الشغور منصب رئيس الجمهورية بحصول المانع لرئيس الجمهورية، أو وفاته، ونظم صلاحيات رئيس الدولة التي تمحورت أساسا بالحظر المطلق، والحظر المشروط للممارسة صلاحيات رئيس الجمهورية أو استقالته، إلى حين شروع تنصيب رئيس جمهورية جديد يضطلع بممارسة مهامه الدستورية. Abstract : Limited constitutional founder under the provisions of Article 104 of the Constitutional Modification 2016, The vacancy of the post of President of the Republic by the impediment of the President of the Republic, or his death, and regulated the powers of the Head of State, which focused mainly on absolute prohibition, and conditional prohibition of the exercise of the powers of the President or resignation, until the inauguration of a new President of the Republic to assume his constitutional functions
