آليات مشاركة المواطنين في تسيير شؤون البلدية في التشريع الجزائري ، أي فعالية؟

الملخص
إن مشاركة المواطنين في تسيير شؤون البلدية تعتبر من المقاربات الهامة في تحريك عجلة التنمية بإشراك مختلف الفاعلين على مستوى الإقليم المعني في صناعة القرار واستغلال قدراتهم في خلق اقتصاد منتج واحداث تنمية شاملة يستفيد منها الجميع. حيث لم يبقى المنتخب المحلي والمسؤول المعين يتوليان اعداد السياسات العمومية بشكل أحادي الجانب وإنما معظم الدراسات تتجه نحو تشريك عدة أطراف في مسلسل قراراتها ومشاريعها المحلية. والهدف من هذه الدراسة هو البحث عن مدى فعالية هذه الآليات المنصوص عليها أساسا في الباب الثالث من قانون البلدية 11-10وتحقيق الفائدة المرجوة منها وانعكاسها على التنمية وبلوغ رضا مجتمعي واسع في كل الأقاليم المحلية، كآلية الإستشارة لمختلف الفاعلين لتقديم مساهمة مفيدة لأشغال البلدية أو مصالحها، وحق الإعلام بنشاطاتها وحضور جلسات مجالسها والإطلاع على مداولاتها وقراراتها لكل المواطنين، والتي تعتيرها بعض الغموض في طريقة تجسيدها عملي، وهذا بغية بلوغ مصاف المقاربة التشاركية كهدف منشود للسلطات العمومية في تبني هذا النموذج على مستوى الجماعات الإقليمية بعد الاعتراف بها في التعديل الدستوري الأخير لسنة 2016. The Citizen participation in the management of municipal affairs is considered an important approach for advancing the wheel of development by involving the various actors at the level of the region concerned in decision-making and by exploiting their capacities to create a productive and a global development that benefits everyone. because the local elected representative and the person in charge did not remain in charge of preparing public policies unilaterally, but most studies are oriented towards the participation of several parties in the series of local decisions and projects. The purpose of this study is to seek the effectiveness of these mechanisms stipulated essentially in chapter three of municipal law 11-10 and to obtain the desired benefit and their reflection on development and to achieve broad societal satisfaction in all local regions, as a mechanism for consulting the various actors to make a beneficial contribution to municipal works or services, The right to inform citizens through its activities, and to allow them to attend its hearings of these councils and to see its deliberations and decisions for all the people involved, because these mechanisms have known an ambiguity in the method of this realization, and in order to reach the level of a participative approach as an object wishes for the public authorities to adopt this model in the local authorities after This recognition in the constitutional amendment of the year 2016
