عقد الامتياز كآلية لاستغلال العقار السياحي

الملخص
تعتبر السياحة أحد القطاعات الأكثر أهمية دوليا، بالنظر لمساهمتها في التنمية المستدامة بشكل عام، على اعتبارها عامل أساسي لتحقيق التوازن الاقتصادي والاجتماعي، خاصة بالنسبة للدول النامية، بسبب عائداتها الضخمة خاصة من العملة الصعبة. وتأسيسا على ما تقدم و لتحفيز الاستثمار في هذا المجال الحيوي عمل المشرع الجزائري على تشجيع المستثمرين في هذا القطاع عن طريق توفير الوعاء العقاري السياحي من خلال أطر قانونية مختلفة، ولعل أهمها صيغة الامتياز كأداة لاستغلال العقارات السياحية بنمطيها مناطق التوسع السياحي والمواقع السياحية Tourism is considered as one of the most important sectors in the world,is contributing in sustainable development in general, and as a main factor for achieving economic and social balance, especially for developed countries because of their huge foreign earning exchange. Based on previous definitions and for encouraging the investments in this necessary field, the Algerian legislator is supported investors in this sector by providing them a touristic real estates through different legal frameworks, the main one is the excellence formula as a tool for exploiting a touristic real estates With its poles forms, expansion areas and touristic sites.
