الملخص

يعد مبدأ الحيطة و الحذر من أهم الأسس التشريعية لمواجهة المشاكل البيئية، وتطور هذا المبدأ ليعتمد عليه المشرع في التصدي للأزمات الصحية خاصة تلك التي تتسبب فيها جائحات الأوبئة، والتي يخفق الطب أحيانا أو يتأخر في ايجاد العلاج الملائم لها في الوقت المناسب، مما يترتب على ذلك نتائج وخيمة تهدد سلامة الصحة العمومية، و للتخفيف من حجم الكارثة والحد من انتشار العدوى يتدخل التشريع في اطار مبدأ الحيطة لوضع بعض القيود تتمثل في جملة من التدابير الوقائية المتخذة هدفها التقليص من بعض الممارسات اليومية التي تعودها الأفراد خلال الحياة العادية. The principle of caution is one of the most important legislative foundations for facing environmental problems, and it has evolved for the legislator to rely on in dealing with health crises, especially those caused by pandemics that medicine sometimes fails or takes a long time to find the appropriate treatment for them which threatens the public health safety, and to reduce the scale of the disaster and stop the spread of the infection, the legislation enters within the precautionary principle to put some restrictions in the form of a set of preventive measures taken with the aim of reducing some of the daily practices that individuals are accustomed to during the normal life.
