الملخص
في هذا المقال سنحاول تسليط بعض الضوء على أحد أبرز خصائص النظام القانوني لمدينة الجزائر التي جعلتها كل الدساتير الجزائرية عاصمة للجمهورية، ويتمثل الأمر في دراسة مميزات التنظيم الإداري بصفة عامة والجانب المتعلق بالتأطير البشري بصفة خاصة، ونعني بذلك استحداث منصب الكاتب العام أو الأمين العام سنة 1967، وذلك بعد أيام قليلة من صدور أول نص تنظيمي بعد استرجاع السيادة الوطنية يتعلق بمدينة الجزائر. وعند معالجة مختلف النصوص القانونية المتعلقة بهذا الموضوع – فيما يخص طبيعة هذا المنصب والاختصاصات التي تضمنها - فالملاحظ أنه مر بعدة مراحل تبعا للتعديلات التي شملت نظام مدينة الجزائر من سنة 1967 إلى غاية سنة 2011. وما خلصنا إليه هو " اختفاء " هذا المنصب بسبب غموض نظام العاصمة، فالفرع يتبع الأصل كما هو معروف. In this article, we will try to shed light on one of the characteristics of the legal status of the city of Algiers, the capital of the Republic according to all the Algerian constitutions. It is a question of studying the specificity of the administrative organization in general and the aspect related to the human framework in particular. We mean by this the creation of the post of the secretary general in 1967, a few days after the promulgation of the first regulatory text governing the city of Algiers after independence. And when we approach the different legal texts related to this subject we see that they have gone through several stages according to municipal laws from 1967 to 2011. We deduced from it is the disappearance of this post due to the ambiguity of the current legal status of the capital.
