القروض المتبادلة حقيقتها وحكمها الشرعي

الملخص
يهدف هذا البحث إلى دراسة موضوع القروض المتبادلة، وبيان حكمها الشرعي. وقد توصل الباحث إلى أن مسألة القروض المتبادلة ليست جديدة، إنما الجديد التسمية؛ فقد تعرض لها العلماء قديما، وكانت تعرف بمسألة "أسلفني وأسلفك"، وقد أجمع العلماء المتقدمون على حرمتها. كما توصل إلى أن ما نسب بعض المعاصرين إلى المالكية من القول بإباحتها خطأ محض ونسبة لا تصح؛ ومردها إلى سوء فهم كلام المالكية في كلامهم على بيوع الآجال. الكلمات المفتاحية: أسلفني وأسلفك؛ القرض بشط القرض؛ القروض المتبادلة. Abstract: This research aims to study the issue of reciprocal loans, and to clarify their Sharia ruling. The researcher concluded that the issue of reciprocal loans is not new, but rather the new name. The scholars were exposed to it in the past, and it was known as the issue of “my ancestor and your ancestor,” and the advanced scholars were unanimously agreed on its prohibition. He also concluded that what some of his contemporaries attributed to the Malikis to say that it is permissible is pure error and a percentage that is not valid. The reason for this is a misunderstanding of the Maliki’s words in their words about the sale of time limits. Key words: Ancestor and ancestor; Loan with the amount of the loan; Reciprocal loans.
