التحايل على القانون المختص في مجال العلاقات الأسرية الدولية

الملخص
تعول التشريعات عند حسمها لمشكلة تنازع القوانين في مجال العلاقات الاسرية الدولية على ضوابط شخصية، تشمل كل من الجنسية، الموطن، وبسبب قابلية هذه الضوابط للتغيير يعمد الأشخاص إلى التحايل على القانون، من خلال تغييرهم لجنسيتهم أو موطنهم، وذلك بغية تحقيق مآربهم والتهرب من أحكام القانون المختص أصلا بحكم النزاع. وبهذا تعتبر العلاقات الأسرية الدولية من أكثر المواضيع إيثارا للتحايل على القانون، ولتجاوز ما يطرحه هذا الموضوع، قررت التشريعات استبعاد القانون الذي انعقد له الاختصاص غشا Legislations rely on personal controls when resolving the problem of conflict of laws in the field of international family relations. These controls comprise both nationality and citizenship and accordingly, on account of their ability to change, people evade the law by changing their nationality or domicile. In other terms, they try to reach their goals and evade the provisions of the law pertaining to the ruling of the dispute. Therefore, international family relations are deemed one of the most frequent topics to circumvent the law. Consequently, in order to override such a problem, legislation has decided to exclude the law that has fraudulent jurisdiction
