الملخص

تهدف هذه الدراسة إلى تسليط الضوء على أهم خاصية من الخصائص التي يتميز بها نشاط الترقية العقارية، كونه يدخل ضمن إطار الأنشطة التجارية المقننة، التي تتمتع بنوع من الخصوصية، الأمر الذي جعل من المشرع يضع قيدا لمباشرتها، يتمثل في الحصول على رخصة تسمح بذلك، بحيث تتمثل الرخصة التي يستوجب على المرقي العقاري الحصول عليها في اطار ممارسة نشاط الترقية العقارية في الاعتماد الذي نظمه المشرع من خلال المرسوم التنفيذي رقم 12-84 المؤرخ في 20 فيفري 2012، الذي يحدد كيفيات منح الاعتماد لممارسة مهنة المرقي العقاري، وكذا كيفية مسك الجدول الوطني للمرقين العقاريين. This study aims to shed light on the most important feature of the real estate promotion activity as it falls within the framework of regulated commercial activities, which have a kind of privacy. This has led the legislator to set restriction for its initiation represented in obtaining a license to permit it. The license that a real estate promoter is required to obtain within the framework of executing the real estate promotion activity is represented in the accreditation regulated by the legislator through Executive Decree No. 124-12, dated February 20, 2012, which determines the methods for granting accreditation to practice the profession of real estate promoter, as well as the way to maintain the national schedule of real estate promoters.
