الملخص

Overriding mandatory rules (lois de police) are the legal rules that regulate and address issues relating to the safeguarding of the public interests of the country. they apply in their domain of application despite the applicable law. they override the provisions of the proper law of contract within their scope of application. The research addresses the notion of lois de police by addressing their different proposed definitions, their relationship with the proper law of contract and the different proposed criteria to identify them. Although there are many criteria, it is recommended that the Egyptian legislator lays down an article defining overriding mandatory rules (lois de police) and the criterion for their identification and application, in line with the comparative legislation and Rome Convention 1980 and Rome Regulation I. It is recommended to adopt a criterion based on the purpose and the exceptional nature. Finally, the research points out the differences between public policy and overriding mandatory provisions from the perspectives of their nature, mechanism of application, and consequences of application.
