جهود السلطة القضائية الجزائرية للحد من انتشار وباء كوفيد 19 داخل المنظومة القضائية

الملخص
تهدف هذه الدراسة إلى تسليط الضوء على كافة التدابير الوقائية التي اتخذتها وزارة العدل الجزائرية على مستوى المؤسسات التابعة لها، والرامية بالدرجة الأولى إلى الحد من انتشار وباء كوفيد 19 داخل المنظومة القضائية، وذلك تماشياً مع السياسة العامة الهادفة إلى الوقاية من انتشار هذا الوباء الخطير، إذ أن هذه التدابير الغرض منها هو الحفاظ على صحة المتقاضين والمواطنين الوافدين على الجهات القضائية والمؤسسات العقابية لتجنيبهم عدوى هذا الوباء ، دون تعطيل مصالحهم وعدم حرمانهم من حقهم في اللجوء إلى القضاء هذا من ناحية، وضماناً لحقوق القضاة والموظفين خاصة فيما يتعلق برواتبهم وحقهم في العطلة السنوية وحفاظاً على صحتهم من هذا الفيروس من ناحية أخرى. كل هذا في جو تسوده السكينة، الطمأنينة والاستقرار؛ ضماناً للسير الحسن للمرفق القضائي. وخلصت هذه الدراسة إلى أن السلطة القضائية لجأت إلى إصدار هذه التدابير قصد حماية الصحة العمومية وضمان استمرارية العملين القضائي والإداري على مستوى جميع الجهات القضائية عوض اللجوء إلى أسلوب الغلق وتفادياً لآثاره الوخيمة. This study aims to shed light on all the preventive measures taken by the Algerian Ministry of Justice at the level of its affiliated institutions. It aimed primarily at limiting the spread of the Covid 19 pandemic within the judicial system, in parallel to the public policy that aimed at preventing the spread of this dangerous epidemic. As these measures are intended to preserve healt and spare of litigants and citizens coming to the judicial authorities and penal institutions from contagion of this epidemic, without disrupting their interests or depriving them of their right to resort to the judiciary. On the other hand, preventive measures could guarantee the rights of judges and employees to their salaries and their right to annual vacation, moreover to preserve their health from this virus. All this in an atmosphere of tranquility, reassurance and stability, to ensure the proper functioning of the judicial facility. This study concluded that the judiciary power has resorted to issue these measures in order to protect public health and ensure the continuity of judicial and administrative work, at the level of all judicial bodies, instead of closing it to avoid its harmful effects.
