إصلاح الحال وفاعليته في استصلاح البيئة "في التشريعين الجزائري والمغربي

الملخص
يشكل الإضرار الذي يصيب البيئة أحد أهم موضوعاتها، وتزداد تلك الأهمية مع ازدياد التحديات والانتهاكات ومع جسامة ما يتخلف عنها، حتى أن النظرة للبيئة اختزلت أو كادت بتلك الأضرار، وظهرت العديد من المفاهيم التي ساهمت التشريعات في تعزيزها، كالتدهور والكارثة والاختلال والتلوث والفساد ...الخ وهي نتاج لما لحق بالبيئة من حيف، وبالمقابل من ذلك نجد مفاهيم أخرى، كالإصلاح وإعادة الحال والترقية والمنع والإرجاع ...الخ وكلما مر زمن برزت أفكار ومفاهيم جديدة يحمل البعض منها مدلولات سلبية والبعض الآخر إيجابية. abstract Damage to the environment is one of its most important issues, and this importance increases with the increase in challenges and violations and with the severity of what is left behind, so that the view of the environment was reduced or nearly as such, and many concepts emerged that the legislation contributed to strengthening, such as deterioration, disaster, imbalance, pollution and corruption ... Etc. It is a product of the injustice that has befallen the environment, and on the other hand, we find other concepts, such as reform, restoration, promotion, prevention and return ... etc. Whenever time passes, new ideas and concepts emerge, some of which have negative connotations and others are positive.
