الملخص
الملخص تهدف هذه الدراسة القانونية إلى توضيح الدور الفعال الذي تلعبه رخصة البناء في ضمان حركة البناء فهي تعتبر أداة قانونية رقابية لأشغال البناء والتوسع العمراني، لا تمنحها الإدارة إلا إذا توفرت الشروط والإجراءات القانونية المنصوص عليها في قوانين التهيئة والتعمير، كما تعتبر من أهم الآليات الوقائية لحماية البيئة من انعكاسات العمران العشوائي واللاشرعي، فرخصة البناء تساهم بشكل كبير في حماية البيئة والطبيعة لاسيما من خلال الشروط المفروضة على البناية والإجراءات البيئية المسبقة الواجب إتباعها للحصول عليها الأمر الذي يعكس ويؤكد العلاقة الوطيدة بين رخصة البناء وحماية البيئة. ولان حماية البيئة من أدبيات التنمية المستدامة فان رخصة البناء وسيلة قانونية تضمن بشكل فعال تحقيق أهداف التنمية المستدامة المنشودة من قبل الدولة الجزائرية . Abstruct : This legal study aims to clarify the effective role that the building permit plays in ensuring the movement of construction. It is considered a legal and supervisory tool for construction works and urban expansion. The administration does not grant it unless the legal conditions and procedures stipulated in the planning and reconstruction laws are met. One of the repercussions of random and illegal construction, the building permit contributes significantly to the protection of the environment and nature, especially through the conditions imposed on the building and the environmental preconditions that must be followed to obtain it, which reflects and confirms the close relationship between the building permit and the protection of the environment. And because protecting the environment is one of the literature on sustainable development, the building permit is a legal means that effectively guarantees the achievement of the sustainable development goals sought by the Algerian state.
