مراعاة الجبلة في التشريع وقواعده

الملخص
تتّجه نظرية التشريع العامة نحو مقصد كليّ يرمي إلى تحقيق مصالح العباد ودرأ المفاسد عنهم، وتنتظم خطّتها في كلياتها وجزئياتها على مراعاة خصائص الإنسان ومكوناته في مختلف جوانبه، باعتباره محور التكليف وغايته، وأنّ تحقيق مصالحه ودفع المفاسد عنه من خلال امتثال الأحكام الشرعية يتطلّب النّظر في مؤهّلاته الطبعية وصفاته الجبلية، باعتبارها مركوزة في أصل خلقته بحيث يستحيل رفعها؛ ولذلك كانت الجبلة مراعاة في التشريع؛ حيث جاءت أحكام الشريعة ملائمة للطبع بما يسهل على المكلف امتثالها على الدوام. والمنهج التشريعي بهذا الاعتبار يُعدّ مظهراً من مظاهر العدل والاعتدال الذي اختصت به شريعة الإسلام وقوانينها؛ وهو ما يحقق نفوذ الشريعة ويؤهلها للبقاء، ويجعلها صالحة للإنسان في كل زمان ومكان، ورائدة بالنسبة لما عرفه الإنسان من الشرائع والقوانين قديما وحديثا. The general theory of legislation is directed towards a holistic goal that aims to achieve the interests of the people and ward off evil from them, in its colleges and parts, its plan is devoted to observing the characteristics of human beings and components in all its aspects, as the focus and purpose of the mandate, and that achieving his interests and pushing the spoils from him through compliance with the legal provisions requires examining his natural capability and instinctive characteristics, as being focused on the origin of it, it was impossible to lift it, therefore, instinct was a consideration in the legislation Where the provisions of Sharia are appropriate for human character, so that the person that is accountable can always comply with it, and the legislative approach in this regard is considered one of the aspects of justice and moderation in which the law of Islam are concerned, and this is what achieves the influence of Sharia and prepares it for survival, and it makes them fit for man in every time and place, and a pioneer in relation to what human beings knew of laws, ancient and modern.
