قراءات في التشريع الايجاري بين نطاق التطبيق، والصياغة اللفظية للنصوص، ومراكز الأطراف

الملخص
ملخص المقال كان الايجار ولا يزال أكثر الأساليب الشائعة لاستثمار الأملاك العقارية ، اذ وفي اطار ما يخوله حق الملكية لصاحبه ، يسعى المالك دوما الى استغلال طيب لملكيته العقارية ــــ لا سيما التي تزيد عن حاجته ـــــ ولن يتسنى له ذلك الا بتأجيرها في ظل وجود أزمة وعاء عقاري يستعمل استعمالا سكنيا أو مهنيا أو تجاريا ، فيذهب ملاك الأمكنة الى تأجيرها والحصول على منافعها ، وبالمقابل ينتفع المستأجر منها ، سواء بشغلها ان كانت محلا سكنيا ، أو ممارسة نشاطا مهنيا أو تجاريا ــــ ان كان معدا لاستغلال مهني أوتجاري ــــ يضر عليه فوائدا وأرباحا . وخص القانون الجزائري عموما التشريع الايجاري بقواعد تميزت بحركية أدت الى غموض في تحديد نطاق تطبيقها ، فضلا عن بعض الصياغات اللفظية التي لا تؤدي مدلولها الصحيح ، لا سيما اذا تعلق الأمر بايجار محل سكني أو مهني ، وفي المقابل أدت القواعد المستحدثة في الايجار التجاري ( ايجار الجدران ) الى تعارض أحكامها ، بالاضافة الى تهديدها لفكرة المحل التجاري كمال معنوي منقول ، في ظل عدم توازن عقدي من شأنه القضاء على الملكية التجارية ( ملكية المحل التجاري ). Summary Rent was and still is the most common method of investing real estate property, as within the framework of what entitles it to the owner of the property, the owner always seeks to make good use of his real estate property - especially that exceeds his need - and he will only be able to lease it in light of the crisis of a real estate container that is used.
