تنازع قرارات مجلس الأمن مع التزامات الدول

الملخص
منح ميثاق الأمم المتحدة لقرارات مجلس الأمن المتخذة في إطار الفصل السابع قيمة قانونية ملزمة في مواجهة الدول الأعضاء و حتى غير الأعضاء في المنظمة، لقد فسر هذا الأثر الملزم على أن قرارات مجلس الأمن مشمولة أيضا بحكم المادة 103، و التي تقرر لها أسبقية في حال التنازع مع التزامات الدول ، الأمر الذي يجعل مصير هذه الالتزامات محل تساءل لاسيما و أن صناعة القرارات في مجلس الأمن لا تخضع في جميع الحالات لاعتبارات المشروعية ، بل لتأثير الأعضاء الدائمين ما قد يحول امتياز الأسبقية إلى وسيلة لهدم النظام القانوني الدولي. كلمات : مجلس الأمن، الالتزامات الدولية، قرارات مجلس الأمن، الدول. Ce qui pourrait transformer le privilège de priorité à un moyen pour anéantir l’ordre juridique international.
