الجهود الدولية والجزائرية لحماية الطفل الشغيل من الاستغلال الاقتصادي

الملخص
الملخص يتناول المقال الجهود الدولية والجزائرية لضمان حماية حقوق الطفل الشغيل من الاستغلال الاقتصادي ، منطلقا من التمييز بين سن الطفل الممنوع فيه من الشغل تماما، والسن الذي يمكنه استثناءً أن يشتغل خلاله لحاجته وأسرته الملحة إلى المال، وقد اعتمد المشرع في قبول تشغيل الطفل على مرافقة المنظمات الدولية والإقليمية المهتمة بحقوق الطفل المشغل بما تصدره في مواثيقها وتطرحه في اتفاقياتها؛ لتوجيه جهود الدول الوطنية لضمان حقوق الطفل من استغلال مشغليه. ورغم ذلك فالواقع يبين مدى الضعف في ضمان هذه الحقوق؛ لأسباب ذكرت في المقال. والهدف من المقال هو رفع الغموض عن مفهومي "شغل الطفل" و"استغلال الطفل اقتصاديا" ونشر الوعي بخطورة الاستغلال الاقتصادي للأطفال؛ لتوجيه أنظار الأوصياء على الأطفال بمشكلة الاستغلال، وتبيان مدى الضمانات القانونية الموفرة لحماية حقوق الأطفال بالمرافقة الدولية والإقليمية والوطنية لهم . والمنهج المتبع هو:المنهج الوصفي. وقد مهد المقال بعرض الواقع الذي يعيشه الطفل الشغيل، والأسباب العامة للجوئه إلى الشغل وآثارها عليه، مع تحديده للمنظمات الدولية والإقليمية المهتمة بالحماية من استغلاله، ثم بين المعايير الضامنة لحقوق الطفل الشغيل من الاستغلال الاقتصادي، والجهود الدولية الإقليمية والجزائرية لضمان حقوق الطفل الشغيل، وآليات كل منهما لتنفيذ النصوص القانونية المشرَّعة في الاتفاقيات والمواثيق الدولية الإقليمية والوطنية، مختتما بتقييم مدى تنفيذ المواثيق المصادق عليها من الدول الوطنية. الكلمات المفتاحية: الطفل. الاستغلال الاقتصادي. الحماية. القاصر. Résumé Le présent article vient traiter les efforts internationaux et algériens visant à protéger l’enfant travailleur de l’exploitation économique. Démarrant de la distinction entre l'âge de l'enfant qui est totalement interdit de travailler et, l'âge pendant lequel il peut travailler exceptionnellement pour son besoin urgent et de sa famille, Et du fait que, le législateur s'est appuyé sur la permission aux organisations humanitaires internationales d’accompagner l’ enfant employé, a travers, ce qu’elles émettent dans ses engagements et accords pour guider les efforts protectrices de l'enfant contre l'exploitation de ses employeurs. Le but de l'article est de lever l'ambiguïté sur les notions de << travail des enfants >> et << 'exploitation économique de l'enfant >> , et de sensibiliser au danger de l'exploitation économique des enfants pour attirer l'attention des tuteurs sur le problème de l'exploitation et montrer l'étendue de la protection grâce à un accompagnement international et domestique. L'ampleur de la vulnérabilité de la protection a été identifiée, en raison de la pauvreté généralisée parmi les enfants et de la cupidité des riches. Pour ceci L'approche descriptive a été suivie. Avant de définir les conventions et accords internationaux relatifs à la protection des enfants contre l'exploitation et ratifiés par l'Algérie. Et après avoir traité les efforts internationaux et algériens ainsi que les mécanismes que les législateurs ont utilisés pour protéger l'enfant et mettre en œuvre les textes juridiques dans les accords et les pactes, On a débuté par exposer , la réalité vécue par l'enfant travailleur dans le monde, les raisons générales du recours au travail et ses effets sur L'enfant, avec l’identification des organismes internationaux intéressés à le protéger de l'exploitation. Pour conclure, on a tenté à évaluer les efforts internationaux et algériens pour protéger l'enfant de l'exploitation économique. Mots-clés :L'enfant. L'exploitation économique. la protection. Mineur Abstract : The paper deals with the issue of the international and Algerian efforts in protecting the working child from economic abuses making a clear distinction between a child forbidden from work and a child allowed exceptionaly to work with respect to a certain age, meeting his and family financial needs. The legislator relies in permitting childs’ work, on the international humanitarian organizations accompanying the working child through their charts and conventions,so as to orient the national efforts in protecting the child from the employees abuses. The paper is organized as follows; Firstly; introducing the child work conditions all over the world revealing the reasons and discussing the outcomes. Secondly: reading through the international charts and conventions ratified by ALGERIA, and presenting the international and Algerian efforts in protecting the working child form economic abuses.
