الملخص
يعتبر الاستثمار الأجنبي في الجزائر من أهم الرهانات التي تسعى الجزائر لكسبها في ضوء انهيار سوق النفط من خلال تكريس مجموعة من النصوص القانونية لحماية المستثمر الأجنبي وتحفيزه من أجل الاستثمار في الجزائر. تعالج هذا الورقة البحثية إشكالية الضمانات القانونية التي جاء بها قانون 16/09 المتعلق بترقية الاستثمار ومدى نجاعتها في خلق مناخ ملائم للمستثمر خارج قطاع المحروقات في الجزائر ولا يتأتى ذلك إلا من خلال تكريس المشرع لضمانات ذات طابع تشريعي وأخرى ذات طابع إداري ومالي ونزع جميع المعوقات التي تشكل حاجزًا أمام المستثمر الاجنبي الذي يسعى دائما للعمل في ظروف مستقرة تشريعيًا واقتصاديًا. The Foreign investment in Algeria is one of the most important bets to pursue Algeria for its gain in light of the collapse of the oil market, by devoting a set of legal texts to protect the foreign investors and motivate him to invest in Algeria. This research paper addresses the problem of the effectiveness of the legal guarantees stipulated in the law of 16/09 related to the promotion of investment and its success in creating an climate for the investors outside the hydrocarbons sector in Algeria. This is to be done only through the devotion of the legislator to guarantees of a nature legislative and other of an administrative and financial nature, and the removal of all the obstacles that constitute a barrier to the investor, he seeks to work in economical and legislative stability.
