النسب والخبرة إشكالات المفهوم والتعريف وضوابط الإعمال والتوظيف بحث في التشريع الأسري والاجتهاد القضائي المغربي

الملخص
يهدف هذا البحث إلى تحليل مفهومي النّسب والخبرة، ومعالجة مختلف ما يرد عليهما من إشكالات نظرية في مستويي الفهم والتنزيل، انطلاقًا من المبادئ والنصوص الشّرعية، ومن التشريع الأسري والتجربة العملية للاجتهاد القضائي بالمغرب. وقد خلص إلى جملة نتائج منها: 1- أهمية التمييز في الأحكام الفقهية المقررة بين ما هو موضوعيّ وما هو إجرائي، لما يتيحه ذلك من فتح آفاق الاجتهادُ في تكييف الأحكام الإجرائية مع مستجدات واقع البحث العلمي. 2- أن الطابع القطعي لنتائج الخبرة الطبية يقتضي إيلاءها ما تستحقه من الأولوية على ما سواها من الوسائل التقليدية الظنية. 3- أن الاجتهاد القضائي ينبغي أن ينفتح على الثروة الفقهية الضخمة التي تضمنتها مصادر المذاهب الفقهية، وأن يحرص على انتقاء ما يستجيب منها لمتجدد أحوال المجتمع. 4- أن الاجتهاد القضائي في قضايا النّسب بما هو واقع تحت رقابة محكمة النّقض يمكنه التأسيس لعمل قضائي يضمن لثوابت التشريع خاصية الاستمرار والملاءمة لمتغيرات الأحوال. Abstract: In this research an analysis of the concepts of lineage and experience, based on the principles and Sharia texts, and from family legislation and the practical experience of the jurisprudence in Morocco. He concluded a number of results, including: 1- The importance of distinguishing between what is objective and procedural in the established jurisprudential rulings in opening the door to diligence in adapting procedural rulings to the developments in the reality of scientific research. 2- The definitive nature of the results of medical expertise requires that it be given the priority it deserves over other presumptive traditional means. 3- That the jurisprudence should be open to the various sources of jurisprudence schools, especially those that respond to the needs of contemporary society. 4- The jurisprudence in the cases of lineage can establish a judicial work that guarantees the characteristics of the legislation continuity and suitability to the variables of conditions Keywords: Expertise-Parentage-Jurisprudence-Evidence-Disavowal-Legislation-Holding of the court-Juristic act
