ميراث المرأة بين الإسلام والحداثة The Inheritance Of Women Between Islam And Modernity

الملخص

الملخص: في إطار الاهتمام المتزايد بقضايا المرأة تبرز قضية المساواة في الميراث كجزئية شغلت بال الكثيرين من المعاصرين، منهم دعاة الحداثة الذين دعوا إلى تغيير قواعد الميراث الثابتة شرعا والتي تكرس في رأيهم تمييزا بين الجنسين الذكر والأنثى؛ ولهذا جاء هذا البحث ليبين مدى صحة هذا الاعتقاد في ضوء فهم مُراد النص الشرعي المؤسّس لقاعدة "لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْن" وسياق وروده وقواعد الميراث العامة المتصلة به، وقد خلصت في الأخير إلى أن للميراث نظامه الخاص في الإسلام، وأن فهم قضية المرأة فيه يستدعي فهما عميقا لمقاصد الإسلام الرامية إلى التكافل الأسري والاجتماعي وبناء أسر على أساس من المودة والتعاون، لا التناحر والتجاذب في الحقوق والواجبات. Abstract: In the context of the increasing interest in women's issues, the issue of equality in inheritance emerged as a partial concern of many of modernity advocates who called for changing the legally established rules of inheritance, which in their opinion establish a distinction between male and female, and this is why this research came to show the validity of this belief to highlight the meaning of the founding legal text ; the rule of "the male is like the fortune of two women" and the context of its emergence and the rules of inheritance related to it. To conclude , inheritance has its own system in Islam and that understanding the issue of women in inheritance needs a deep understanding of the purposes of Islam aimed at family and social solidarity and building families on the basis of affection and cooperation, No antagonism and conflict about rights and duties.
