تطبيق نظرية السيادة في الدساتير الجزائرية

الملخص
نظرية السيادة من النظريات الهامة في مجال القانون الدستوري،نظرا لتأثيرها على شرعية السلطة وحدودها ،وقد أخذت دساتير الدول الحديثة بهده النظرية ومن بينها الدساتير الجزائرية،وتنقسم هده النظرية إلى نوعين نظرية سيادة الأمة ولها نتائجها ونظرية سيادة الشعب لها كذلك نتائجها . وهناك من أخد بالنظريتين وجمع ينهما ومنهم المؤسس الدستوري الجزائري ،عبر الأخذ ببعض آليات نظرية سيادة الأمة ونظرية سيادة الشعب،ومن أجل تكريس سيادة الشعب أو الأمة لابد من توافر بعض الضمانات من أجل التجسيد الفعلي لهده السيادة. La théorie de la souveraineté est l' une des théories les plus importantes dans le domaine du Droit constitutionnel en raison de son impact sur la légitimité de l’autorité et ses limites. Les constitutions des pays modernes ont repris cette théorie parmi les quelles les constitutions algériennes. Il y a ceux qui ont repris les deux théories et les ont combinées, y compris le fondateur constitutionnel algérien, en adoptant certains des mécanismes de la théorie de la souveraineté nationale et de la théorie de la souveraineté du peuple. The theory of sovereignty is one of the most important theories in the field of constitutional law because of its impact on the legitimacy of authority and its limits. The constitutions of modern countries have taken up this theory, including the Algerian constitutions. There are those who have taken both theories and combined them, including the Algerian constitutional founder, adopting some of the mechanisms of the theory of national sovereignty and the theory of the sovereignty of the people.
