الاطار القانوني لمكافحة الفساد الاداري في الجزائر

الملخص
ملخص : الفساد الاداري ظاهرة تؤثر على اقتصاد الدولة، و تعتبر من آفات المهددة للأمن الاجتماعي و النمو الاقتصادي، و لمحاربتها رصدت لها الدولة الجزائرية جملة من الآليات القانونية و الاجراءات الادارية و الجزائية تضمنتها مختلف النصوص القانونية ذات الصلة. لقد تدعمت استراتيجية الدولة في محاربتها للفساد بإنشاء هيئات إدارية مختصة بمكافحة الفساد الإداري المتمثلة في الهيئة الوطنية للوقاية من الفساد و مكافحته و التي تم دسترتها ضمن التعديل الدستوري لسنة 2016 و اعتبرت سلطة إدارية مستقلة. و كدا إنشاء الديوان المركزي لقمع الفساد. Abstract : Administrative corruption is a phenomenon that affects the state economy, and is considered a scourge that threatens social security and economic growth, and to fight it, the Algerian state has monitored a number of legal mechanisms and administrative and penal procedures contained in the various relevant legal texts. The state's strategy in combating corruption has been supported by the establishment of administrative bodies to combat administrative corruption in Algeria, namely the National Commission for the Prevention and Prevention of Corruption, which was established under the 2016 constitutional amendment and was considered an independent administrative authority. This was the establishment of the Central Bureau of Corruption Suppression.
