الحق في حرية التعبيروالمجتمع الديمقراطي التعددي : مقاربة قضاتئية

الملخص
يسعى هذا البحث إلى كشف الصلة بين الحق في حرية التعبير و المجتمع الديمقراطي التعددي، ولا تتم المكاشفة إلا بتحديد طبيعة العلاقة بين الحق في حرية التعبير ومختلف أوجه التعددية في المجتمعات الديمقراطية. هذه العلاقة قد تكون من طبيعة توافقية حيث يخدم إعمال الحق في حرية التعبير تعددية الآراء والقناعات ما يقوي المجتمع الديمقراطي ويحصنه، وقد تكون العلاقة من طبيعة تصادمية حيث يهدد التعبير التحريضي أو التمييزي أو خطاب الكراهية أسس التعايش السلمي داخل المجتمع الديمقراطي ويقوض قيمة التعددية التي يقوم عليها، مما يستوجب تقييده ومنعه. This research seeks to uncover the relation between freedom of expressionright and pluralistic democratic society. The disclosure is made only by defining the nature of the relationship between the human right of freedom of expression and the various aspects of pluralism in democratic societies. This relationship could be of a consensual nature where the realization of freedom of expression right serves the pluralism of views and convictions that strengthens and fortifies the democratic society. On the other hand, this relationship might be of a confrontational nature where inciting or discriminatory expression or hate speech destroys the foundations of peaceful coexistence within a democratic society and undermines the value of pluralism upon thus it must be restricted and prohibited.
