الملخص

عرف الفقه المالكي خلال العهد الزياني عودة قوية حيث برز في هذه الفترة فقهاء أعلام كانت لهم مكانة علمية تظهر من خلال كثرة تلاميذهم وغزارة تأليفهم في العديد من العلوم المختلفة، كما تظهر أيضا في اعتناء وحفاوة سلاطين بني زيان بهم، حيث كانوا يتميزون بالنزعة العلمية والثقافية والعناية الدائمة بتشجيع الفقهاء، كما ظهر خلال هذا العهد تيار التصوف الذي اعتنقه العديد من الأعلام على اختلاف مستوياتهم الثقافية. وبسبب اختلاف التكوين العلمي والنفسي لكلا الفريقين فقد وقع بينهما صراع فكري تمظهر بعدة مظاهر، وفي هذا السياق يأتي موضوع هذه المقالة حيث سنحاول من خلالها رسم ملامح لنوع العلاقة التي ربطت الفقهاء بالمتصوفة في تلك الفترة الزمنية الهامة من تاريخ المغرب الأوسط الزياني. Abstract: Maliki jurisprudencehas witnessed during the Zayani era astrong comeback.Since, during this period, a lot of scholars with a scientific standing appeared through the large number of their students and their authorship in many different sciences. Additionally, it through the caring given by the Zayani sultans as they were famous by their scientific and cultural tendency and their permanent encouragement of the jurists. Also, during this era, the the trend of Sofism appeared and was embraced by many scholars of different cultural levels. Because of the difference in the scientific and psychological background of both groups, an intellectual conflict occurred between them;and whichmanifested itself in several ways. in this context, the topic of this article, has been put forward inorder to try to draw features of the type of relationship between the jurists and the Sufis during that important period in the history of the Middle Zayani Maghreb. .Keywords:Conflict ; Intellectuel ; Jurists ; Sufis; The Zayani era.
