الملخص
يعدّ القرآن الكريم والسنة المطهرة المصدرين التشريعيين اللذين يستنبط من خلالهما الأحكام الشرعية التي تضمن السعادة في الدارين، ولا يكون فهم الأحكام الشرعية صحيحًا إلا إذا رُوعِيَ فيه مقتضى أساليب العربية، وطرائقها الدلالية، وما تتضمنه ألفاظها من معانٍ. وقد كانت هناك قضايا عديدة ذات اهتمام تركيبي وسيميولوجي ودلالي وتداولي كان للأصوليين فيها فضل السبق. لا يستطيع الباحث فهم الألفاظ إلا بواسطة الوقوف على أصل وضعه اللغوي، وكيفية استعماله في المعنى الموضوع له. وغني عن البيان أن الأصوليين قد اهتموا بالمباحث الدلالية، وتوصلوا إلى نتائج ذات قيمة علمية عالية تلتقي مع كثير ممّا توصل إليه البحث الدلالي عند اللغويين المعاصرين، في التعميم والتخصيص والغموض والوضوح والحقيقة والمجاز والمشترك اللفظي، وغير ذلك من القضايا الدلالية. ومن هذا المنطلق، كان موضوع ورقتنا البحثية يتمحور في:العلامة اللسانية عند الأصوليين في ضوء الدرس اللساني الحديث. محاولين إضاءتها وقراءتها في ضوء ما توصلت إليه الدراسة اللسانية الحديثة، من تداولية وسيميائية. طامحين كذلك إلى قراءة هذا الإرث، ولاسيما أن أغلب آيات الأحكام ظني الدلالة، وهذا مظهر من مظاهر الإعجاز؛ إذ تظل قراءته مفتوحة على مر العصور. The Qur'an and the Sunnah are the legislative sources, which the Shari'a rulings are derived. The understanding of the rulings of the Shari'a is valid only if it takes into account the requirements of the Arabic language, its semantic methods and the meaning of its words. There have been many issues of structural, semiological, semantic and pragmatic interest, in which the Scholars of the principles of jurisprudence have precede them. The researcher can only understand the words by standing on its epistymology, and how it is used. It goes without saying that those scholasr have been interested in semantic investigations and have reached results of high scientific value that converge with many of the findings of semantic research among contemporary linguists in: generalization, specialization, ambiguity, reality and metaphor principle, verbal and other semantic issues. From this perspective, the subject of our research paper is: The view of Scholars of the principles of jurisprudence in the linguistic sign in the light of the modern linguistics. We also aspire to read this legacy, especially since most of the verses of the rulings are a sign of significance that It remains open through out the ages.
