توجهات السياسة الجنائية الحديثة في قانون الأعمال الجزائري

الملخص
تشهد السياسة الجنائية الوطنية في ميدان الاعمال اهتماما قانونيا واسعا, تزامنا مع المتغيرات الاقتصادية والتوجه نحو اقتصاد السوق, وهو مايطرح عدة تصورات مستقبلية لها, والتي تهدف إلى غايتي إعطاء فرصة للوقاية من الانحرافات وردع الانحرافات, غير أن هذا التصور يتطلب شروط ومعايير تتعلق بالمصلحة المحمية, والضرر الناجم جراء المخالفة المرتكبة. التجريم في ميدان الأعمال له خصوصية, مما حذا بتشريعنا الوطني إلى البحث عن البدائل المتاحة في هذا الإطار وتفادي العقوبات الجزائية وكثرتها وبالتبعية تراكم الملفات في المحاكم ومنه مسايرة التشريعات الحديثة التي تشجع العقوبات الإدارية إما بإخراج الجرائم قليلة الأهمية من نطاق القانون الجنائي إلى نطاق القانون الإداري, وإما بتخيير المخالف بين التسوية القضائية والتسوية الإدارية لمخالفته أو مختلف الحلول مراعاة لمنهجية السياسة الجنائية لكل دولة. وعليه إذا كان الاقتصاد الموجه في الجزائر عرف موجة تجريم موسعة لعالم الأعمال فإلى أي مدى تم التوجه نحو البدائل المتاحة في ظل التوجه الجديد لاقتصاد السوق؟ الكلمات المفتاحية: التجريم-القضاء- العقوبة-الاعمال-الاقتصادي Abstract: The national criminal policy in the field of business is witnessing wide legal interest, coinciding with economic changes and the orientation towards a market economy, which raises several future scenarios for it, which aim at my goal to give an opportunity to prevent deviations and deter deviations, but this perception requires conditions and standards related to the protected interest, And the damage caused by the violation committed Criminalization in the field of business has its own specificity, which prompted our national legislation to search for alternatives available in this framework and to avoid penal sanctions and their abundance and by extension the accumulation of files in the courts, including keeping pace with modern legislation that encourages administrative penalties, either by removing minor crimes from the scope of the criminal law to the scope of administrative law Or, by choosing the violator between the judicial settlement and the administrative settlement of his violation, or various solutions, taking into account the methodology of the criminal policy of each country. Accordingly, if the command economy in Algeria experienced an expanding criminalization wave in the business world, to what extent were the available alternatives directed in light of the new trend of the market economy?
