خصوصية المنازعة الإدارية "منازعات الصفقات العمومية في الجزائر أنموذجا"

الملخص
الملخص: تعد الصفقات العمومية أحد أهم أنواع العقود الإدارية في الجزائر، تخضع لقواعد معينة سواء في طرق إبرامها أو إجراءات تنفيذها، إذ تهدف هذه الدراسة إلى البحث في مجال تميز المنازعة الإدارية الخاضعة لتنظيم الصفقة العمومية، وتحديد الجهة القضائية المختصة بالفصل في المنازعات الناتجة عن هذا النوع من العقود. ونظرا للخصوصية التي تتمتع بها الصفقات العمومية لتنوع المراحل والإجراءات التي تمر بها الصفقة، هذا الأمر أدى بالنتيجة إلى تنوع رقابة القاضي الإداري بالنظر إلى نوع الدعاوى التي يمكن أن تكون موضوعا لمنازعات الصفقات العمومية، واسناد إختصاص الفصل في منازعات الصفقة العمومية للقاضي الإداري على أساس المعيار العضوي، وإن كان يظهر في بعض الأحيان استعانة المشرع الجزائري بالمعيار المادي لإعماله كلما دعت الضرورة ذلك. Abstract: Public deals are one of the most important types of administrative contracts in Algeria, subject to certain rules, whether in the ways of concluding them or the procedures for their Implementation, as this study aims to research in the field of distinction of administrative disputes subject to the organization of the public deal, and to determine the judicial authority competent to adjudicate the disputes resulting from this type of contracts. In view of the privacy enjoyed by public deals procurement of the diversity of stages and procedures that the deal goes through, this matter has resulted in the diversity of the administrative judge's oversight in view of the type of cases that may be the subject of public procurement disputes, and assigning the jurisdiction to adjudicate in public transaction disputes to the administrative judge on the basis of the organic standard, and even if it appears sometimes the Algerian legislator uses the material standard to apply it whenever necessary.
