الملخص

الملخص: بالنظر إلى الجدل الكبير الذي أثاره موضوع تنفيذ أحكام زيارة المحضون في ظل إنتشار فيروس كورونا- كوفيد 19- على مواقع التواصل الإجتماعي "فيسبوك" وفي أروقة المحاكم، تأتي هذه الدراسة لإبراز أهمية تنفيذ هذه الأحكام في حياة كل من الطرف غير الحاضن، والمحضون باعتباره المستفيد الحقيقي من حق الزيارة، وتوضيح الأثر السلبي لإنتشار فيروس كورونا على هذا الحق، من خلال تعطيل تنفيذ الأحكام القاضية به، نظرا لما استلزمه من فرض تدابير وإجراءات وقائية صارمة للحد من إنتشاره -خاصة الحجر المنزلي- ومناقشة مدى نجاعة تعليق تسليم الطفل المحضون لصاحب الحق في زيارته، في تحقيق المصلحة الصحية للطفل المحضون. Abstract: Given the big controversy that raised by the issue of executing the judgements of visiting the child under custody in light of the Corona virus - Covid 19- spread , on social media "facebook" and in the corridors of the courts ,This study comes to highlight the importance of executing these judgements in the lives of both the non-custodial party and the child , as it is the real beneficiary of the right to visit, And to clarify the negative effect of the Corona virus spread on this right, by delaying the execution of the judgments ruling it, Given the strict precautionary measures that it necessitated to limit its spread - Especially the home quarantine - and discussing the effectiveness of suspending the delivery of the child under custody to the person who has the right to visit him, in achieving the health interest of the child under custody .
