الإلتزام بإعلام المستهلك في عقد الإستهلاك الإلكتروني

الملخص

من أبرز الحقوق التي يجب ضمانها للمستهلك عامة و المستهلك الإلكتروني خاصة، الحق بالحصول على معلومات حقيقية و غير خادعة و لا مضللة، بمعنى حقه بالحصول على الحقائق. وقد أصدرالمشرع الجزائري القانون رقم 89/02 المؤرخ في 07/02/1989المتعلق بالقواعد العامة بحماية المستهلك المعدل و المتمم بالقانون رقم 09/03 المتعلق بحماية المستهلك و قمع الغش، و قد خصص المشرع في معظم القوانين الخاصة بحماية المستهلك نصوصا تكرس حق المستهلك في الإعلام، فنجده ينص في المادتين 17 و 18 من القانون رقم 09/03 على هذا الحق. و يقصد بالحق في الإعلام حق كل إنسان أن يتلقى و ينقل المعلومات و الأنباء و الآراء على أية صورة دون تدخل من أحد. أما الإعلام في مجال الأنترنيت يقصد به منح المستهلك كل المعلومات اللازمة لمساعدته في اتخاذ القرار بالتعاقد من عدمه، و هو التزام يقع على عاتق المهني، و يدرج ذلك ضمن عقود التجارة الإلكترونية، و منها الإعلام بقوانين المعلوماتية و الحريات، و التساؤل الذي يطرح هو أنه مادام الإعلام حق للمستهلك يقع على عاتق المهني، فما جزاؤه في حالة الإخلال بهذا الإلتزام؟ و هل يساهم الإعلام التجاري في حماية المستهلك الإلكتروني وفقا للقانون الجزائري؟ One of the most important rights that must be guaranteed to the consumer in general and the electronic consumer in particular is the right to obtain real, non-deceptive and misleading information, in the sense that he is entitled to the facts. The Algerian legislator issued Law No. 89/02 of 07/02/1989 on the general rules of consumer protection amended and supplemented by Law No. 09/03 on consumer protection and suppression of fraud. In most consumer protection laws, the legislator has devoted provisions that enshrine the right of the consumer to the media, we find in this article, articles 17 and 18 of Law No. 09/03. The right to information means the right of every human being to receive and transmit information, news and opinions on any form without interference from anyone. Internet media is intended to give the consumer all the information necessary to help him or her decides whether to contract or not. It is an obligation that falls on the professional. This is included in e-commerce contracts, including information technology and freedoms laws. The question is that As long as the media is the right of the consumer falls on the professional, what is the penalty in case of breach of this obligation? Does the commercial medium contribute to the protection of electronic consumers according to Algerian law?
