تفعيل عقوبة الإعدام في جريمة اختطاف الأطفال على ضوء القانون الجزائري

الملخص
يحتل موضوع الحماية القانونية للطفل ووقايته من الاختطاف، درجة بالغة الأهمية تستوجب التطرق له وتحليله بكل دقة وجدية، كون هذه الظاهرة الإجرامية الخطيرة قد مست فئة من المجتمع تعتبر مستقبل كل أمة، كما أنها النواة الأساسية لتقدم الشعوب، فضلا عن كون بشاعة وجسامة هذه الجريمة تزداد درجة، كلما صاحبتها جملة من الجرائم اكثر خطورة من الاختطاف أو كانت لاحقة له، الأمر الذي أدى إلى تغليظ العقوبات المقررة لمقترفيها لتصل إلى أقصى حد، غير أنّ هذا الجزاء الخطير بالرغم من النص عليه ضمن أحكام قانون العقوبات، وكذا النطق به علنا من خلال الأحكام الصادرة عن القضاء الجزائري، إلا أنّه لا ينفّذ على أرض الواقع نتيجة لقرار تجميد تنفيذ هذه العقوبة قرابة ربع قرن. The question of the legal protection of the Algerian child and its prevention against the crime of child kidnapping takes on a very degree of importance that requires precise and serious treatment and analysis. Since this dangerous criminal phenomenon has affected a sensitive category of society that is considered to be the future of every nation, being the basic nucleus for the progress of peoples, Moreover, the atrocity and seriousness of this crime increases its classification due to its association with a group of crimes more serious than the original crime and the crime of kidnapping will be subsequent to it. This has led to the intensification of the punishments prescribed for the perpetrators of this crime to reach the maximum level, namely the death penalty. However, the latter, despite stipulating it within the provisions of the Penal Code, as well as pronouncing it publicly through the rulings issued by Algerian courts, is not applied on the ground following the decision to freeze this punishment for nearly a quarter of a century.
