تأثير الاعتراف على الحرية الفردية للمتهم في التشريع الجزائري The Effect Of Recongnition On The Accused's Individuel Freedom In Algerian Legislation

الملخص

من حقوق الدفاع المكفولة للمتهم حقه في الالتزام بالصمت أثناء استجوابه من قبل قاضي التحقيق، إلا أنه في بعض الحالات يمكن أن يقر المتهم عن نفسه بالتهمة المسندة إليه سواء كان كلها أو بعضها بصفته فاعلا أصليا أو شريكا، وهنا يبرز الاعتراف كدليل يسقط به المتهم بنفسه قرينة البراءة الأصلية إلا أنه وحتى يتم الأخذ بالاعتراف كدليل من أدلة الإثبات لابد من توفر أركان لازمة لوجوده وشروط لازمة لصحته. وبما أن حماية السلامة الجسدية الذهنية للمتهم من أهم الحريات الفردية المقررة للمتهم في جميع مراحل الدعوى العمومية، فإنه من أهم الشروط الأساسية التي يجب ان تتوفر في الاعتراف هو أن يصدر عن طواعية واختيار وأن يكون للمتهم متحررا من أي ضغط أو تأثير سواء كان ماديا أو معنويا، أي أن تكون إرادة المتهم حرة أثناء الاعتراف. One of The accuser's rights to defend is his right to remain silent during interrogation by the investigating judge, but in some cases the accused may plead for the charge, whether he or she is a principal participant or a partner. Which can lead to the renouncement of the presumption of innocence by the accused himself However, in order for recognition to be recognized as evidence , it is necessary to have the necessary elements for its existence and the conditions necessary for its validity And since the protection of the physical and mental integrity of the accused is one of the most important individual freedoms recognized in all stages of public proceedings, therefore one of the most important prerequisites that must be met in a confession is that it is voluntarily and freely chosen, and that the accused is free from any pressure or influence. Physically or morally, that is, the will of the accused is free during the confession.
