الملخص

يتعلق هذا البحث بالنظر الفقهي لبيع تلقي الركبان وتوظيفه على الواقع المعاصر، حيث بدأنا بداية بتعريف بيع تلقي الركبان ثم انتقلنا إلى بيان حد منتهى تلقي الركبان ثم وقفنا على حكم بيع تلقي الركبان إلى أن وصلنا إلى توظيف تلقي الركبان على الواقع المعاصر، وأجملنا النتائج وتبين لنا أنّ النهي عن تلقي الركبان عند من يراه تعبداً أي :لا يُعقل معناه: هل هو لحظ الجالب أو هو لحظ أهل البلد حماية لهم من احتكار المتلقي أو رفعه الأسعار؟ فلتزاحم الأوصاف التي يُحتمل تأثيرها صار عند البعض تعبدياً، وهذا المعنى لا تدخله البدعة؛ لعدم وجود مقدر ومحدود من زمان أو مكان أو صفة أو عدد؛ لأنّ إلحاق حكم البدعة لا يُتصوّر إلا بتغيير في محدود ولا يوجد في هذا الّنوع شيء من ذلك؛ فالتعبّد هنا إنّما اعتبر في أصل شرع الحكم لا في تفاصيله وصلى الله على نبينا محمد وعلى آله وأصحابه أجمعين. This research relates to the jurisprudential view of the sale of receiving stirrups and employing it on contemporary reality, where we started by defining the sale of receiving stirrups, then we moved to a statement of the end of receiving stirrups, and then we stood on the ruling on selling stirrups until we reached the employment of receiving stirrups on contemporary reality, and we outlined the results and showed us That the prohibition on receiving stirrups for those who see it as worship, meaning: It does not make sense: Is it the luck of the gripper or is it the luck of the people of the country to protect them from the monopoly of the recipient or raise prices? So the crowding of descriptions that may influence it has become for some worshipers, and this meaning is not included in heresy. The absence of an estimator and a limit of time, place, characteristic or number; Because appending the rule of heresy is not conceivable except with a limited change, and there is nothing of that kind in this type. Devotion here is considered in the original Sharia law, not in its details, and may God bless our Prophet Muhammad and his family and companions as a whole.
