مراعاة الخلاف عند أئمة الأحناف

الملخص
هذا البحث نموذج لبيان عمل كبار الفقهاء بمراعاة الخلاف، واخترت منهم أئمة المذهب الحنفي أبا حنيفة وصاحبيه أبا يوسف ومحمد بن الحسن، وهو في الوقت ذاته يدل على حسن تنزيل الأحكام على الواقع وفق مقاصد الشريعة، وسعة الفقه الإسلامي، وروح التسامح فيه ونبذ التعصب للرأي، وما أحوجنا إليه اليوم كثيراً. سقت لذلك مسائل من أبواب شتى تمثيلاً له لا استقراء، فهي أكثر من أن يسعها مقال، سواء في الكتاب المنتخب، أو في بقية كتبهم التي يقوم عليها مذهبهم، فالغرض إثبات عملهم به؛ وختمت كل هذا بخاتمة تحمل نتائج البحث، كذكر أسباب عدولهم إلى قول غيرهم، واحتياطهم في حفظ مقاصد الشارع، وبعض المقترحات. this research is a model on the work of the senior jurists with the consideration of the other opinion, i chose the imams of the Hanafis, which at the same time indicates the good to put judgments on the reality according to the purposes of the Shari'a, immensity of Islamic jurisprudence, the spirit of tolerance and the rejection of intolerance to opinion, we need so much today. I have cited examples of various chapters to present and not extrapolate, there is much to be in article because the purpose to prove that they use it ; All this was concluded by a conclusion bearing the results of the research, such as mentioning the reasons for their Consider others people's, emphasizes their interested benefit according to the Sharia, and some proposals.
