الواقع الصحي و الاجتماعي لذوي الإعاقات في الجزائر مفارقات بين التشريعات و الواقع المعاش

الملخص
ملخص: مع زيادة عدد المعاقين في العالم يزداد عدد المهتمين بإزالة الحواجز المعيقة لتمكينهم ،إذ أن المجتمع الدولي بدا بتسليط الضوء علىهم منذ السبعينيات من القرن الماضي ، بإنشاء منظمات محلية و عالمية ، تمخض عنها إبرام اتفاقية تهدف إلى التكفل بهم سنة2006 م. و إذا ما تطرقنا إلى فئة المعاقين في الجزائر نجد أن التشريعات بخصوص حقهم في الحياة و الصحة و التعليم ...، كُفلت لهم بعد الاستقلال مباشرة ،و قد تجسدت هذه الرؤية نحوهم بتشريع متكامل خاص بحمايتهم و ترقيتهم سنة 2002 م، و بهذا تعدالجزائر من البلدان السباقة في مجال سن القوانين الخاصة بهم،إذ سبقت تشريعاتها ، صدور الاتفاقية الدولية لذوي الإعاقة. و في هذا المقال نسعى إلى التعرف على فحوى الاتفاقيات المبرمة بحق هذه الفئة على المستوى الدولي و المحلي، و مدى تطبيق بنودها في الواقع المعاش في الجزائر ، خاصة و أنها تعد أكثر من 2مليون معاق أي ما يعادل 11./. من السكان. Abstract: Parallel to the increase in the number of people with disabilities in the world, the number of people interested in removing barriers to empowerment in their societies is increasing, the international community began highlighting them since the 1970, by establishing local and international organizations and federations, it resulted in the conclusion of an agreement in their name in2006 aimed at sponsoring them ,and Algeria ratified it in 2009. And if we turn to the category of the handicapped in Algeria, we find that legislation and laws regarding their right to life, health, education, work, and respect are guaranteed immediately after independence, this vision towards them was embodied in a special integrated legislation to protect and raise them in the year2002, thus Algeria is one of the leading countries in the field of enacting laws regarding them. As its legislation precedes the issuance of the international convention for persons with disabilities, issued in2006. In this article, we seek to get acquainted with the agreements concluded against this group at the international and local levels and the extent of application of the provisions of the agreements on the ground in Algeria, which is more than 2million persons with disabilities, or 11 percent of the total population.
