الملخص
ملخص: تهدف هذه الدراسة لتسليط الضوء على الأسس المنهجية والعقلية لعلاقة النص بالواقع نموذج المصلحة المرسلة ، واستعرضت بداية مقدمة احتوت على أهمية الموضوع وأهدافه ، وطرح الإشكالية ، كما تطرقت إلى مفهوم ومصطلحات القواعد والضوابط كمفهوم المصالح المرسلة ومراتب المصالح والأسباب الداعية إلى الأخذ بالمصالح المرسلة والأحكام التي تراعي فيها، و شروط الأخذ بالمصالح المرسلة وأراء الفقهاء في بناء الأحكام عليها ، وعلاقة النص بالواقع من خلال تطبيق المصلحة المرسلة ،ثم ختمتها بأهم النتائج . الكلمات المفتاحية: المصلحة ؛ المرسلة ؛ الأسس ؛ المنهجية ؛ العقلية الواقع .
