الملخص
ملخص: غرض المشرع الجزائري من استحداث قانون 15-08 بيان قواعد مطابقة البنايات وإتمام انجازها، خاصة لما استند على قاعدة، مفادها أن المظهر الجمالي والمحافظة عليه من النظام العام، هذا ما يؤخذ بالإيجاب على المشرع الجزائري، على الرغم من إغفال هذا الأخير لبعض الجوانب إلا أنه نجح في وضع آليات لتنفيذ قانون 15-08 في فترة وجيزة جدا أي سنة 2009 بعد إصداره لثلاثة مراسيم تنفيذية، تتعلق بلجنتي الدائرة و الطعن وإجراءات تنفيذ المطابقة وشروط وكيفية تعيين فرق التحقيق و المتابعة، وسيكون القانون المذكور أكثر فعالية ميدانيا إذا تم الأخذ بآليات تنفيذه. الكلمات المفتاحية: قانون، مطابقة، البنايات، قواعد، إتمام إنجازها، آليات تنفيذها. Abstract: The Algerian legislator, by creating the law N° 15-08, aims at defining the buildings’ conformity rules and their completion, notably when relying on the rule stipulating that the aesthetic appearance and its preservation makes part of the public order, which counts positive to the Algerian legislator, despite that the latter neglected some aspects, but it managed to set up mechanisms to execute the law n° 15-08 in a short span in 2009 after issuing three executive decrees, related to district and appeal commission, also the procedures for the implementation of the conformity, conditions and modalities to designate investigation and follow-up teams. The foresaid law will be more effective on the ground if its mechanisms are taken into account. Key words: Law, conformity, buildings, rules, completion, implementation mechanisms.
