الديمقراطية المحلية كمدخل لاصلاح الجماعات الإقليمية من منظور عقلنة تدخل الدولة

الملخص
ارتبط تطور الإدارة المحلية في الجزائر بشكل كبير بالتحولات التي شهدها النظام السياسي والاقتصادي منذ الاستقلال والثابت فيه-رغم تباين مرحلتي ما قبل التعددية السياسية وما بعدها- أن الجماعات الإقليمية تشكل قاعدة وأساس للتنمية المحلية ودعامة للتنمية الوطنية، و بكونها فضاءً عموميا للتعبير الحر عن الاحتياجات العمومية المحلية، و ضامنة لتحقيق ديمقراطية فعلية عبر القنوات التي توفرها للسكان المحليين للتعبير عن رغباتهم. وقد تعزز هذا التوجه بتعديل قانونَيْ البلدية و الولاية في 2011 و 2012 تواليا، حيث ابتغى المشرع من وراء هذا الإصدار الجديد للقانونين تجاوز النقائص و الاختلالات الوظيفية المتعلقة بضعف القدرات المالية والبشرية للجماعات الإقليمية من خلال إرساء لأول مرة مبادئ الديمقراطية المحلية بشكل مباشر، و كذا دسترة الديمقراطية التشاركية في التعديل الدستوري لسنة 2016، هذا ما يساهم في انتقالها نحو تبني نمط جديد للتسيير العمومي أساسه تقليص تدخل الدولة على المستوى المحلي وفق قواعد و مبادئ الحكم الراشد. Abstract: The development of Algeria's local governance has been largely linked to the transformation of the political and economic system since independence, despite the different stages of pre-political pluralism and beyond that regional groups form the basis for local development and support for national development, and that they are a public space for free expression of local public needs. It is a guarantee of a genuine democracy through the channels that it provides to the local population to express their wishes, and it also requires the support of its independence in making local decisions. This approach can be strengthened by the amendment of municipal and state law in 2011 and 2012, where the legislature, behind this new version of the two laws, has gone beyond the shortcomings and functional imbalances of the weak financial and human capacities of the regional communities by establishing for the first time the principles of local democracy directly, as well as constitutionalizing Participatory democracy in the 2016, This is what allows to its transition toward a new pattern of public administration based on reducing state intervention at the local level in accordance with the rules and principles of good governance.
