جرائم التواصل غير المشروع بالدول الاجنبية والتنظيمات الارهابية ( دراسة مقارنة في التشريع العماني والمصري لجرائم السعي والتخابر)

الملخص
تشكل جميع اشكال وصور التواصل والاتصال غير المشروع بالدول الاجنبية والتنظيمات الارهابية وبمختلف الوسائل وبغض النظر عن الاهداف المراد تحقيقها وسواء اوقع ذلك الفعل في زمن السلم او زمن الحرب سلوك وتصرف ضار ومهدد للأمن القومي للدول , بالتالي يدخل هذا التواصل والاتصال غير المشروع من ضمن الجرائم الماسة بأمن الدولة من جهة الخارج . وتتنوع صور الاتصال والتواصل غير المشروع بالدول الاجنبية والتنظيمات الارهابية بحسب الاهداف المراد تحقيقها من قبل المتخابر او الساعي , فقد يهدف ذلك التواصل غير المشروع الى التعاون مع الدولة الاجنبية للحصول على المال او اللجوء السياسي , او للانتقام من النظام الحاكم في بلد المتخابر عبر القيام بعمليات ارهابية , او لأي سبب اخر. كما قد تنجح بعض أجهزة استخبارات تلك الدول او حتى التنظيمات الارهابية في تجنيد بعض الافراد سواء كانوا مواطنين او مقيمين تابعين لدول اخرى او حتى تابعين للدولة المتخابر لصالحها , او التنظيم الارهابي لتحقيق اهداف استخباراتية او عسكرية , أو ارهابية . كما قد يتم الاتصال غير المشروع ببعض الدول من قبل بعض الافراد في اوقات معينة كأوقات الحرب للإضرار بالعمليات العسكرية للدولة المستهدفة , او قد يتم في زمن السلم او الحرب كذلك بهدف الاضرار بمركزها السياسي او الدبلوماسي او الاقتصادي او غير ذلك عبر التعاون معها تجاريا او اعلاميا او سياسيا او غير ذلك . Abstract:- All forms and forms of unlawful communication and contact with foreign countries and terrorist organizations by various means and regardless of the goals to be achieved, and whether or not that act is committed in peacetime or wartime, constitute harmful and threatening behavior and behavior for the national security of states, thus this illegal communication and communication is among the crimes affecting security The country from the outside. The forms of unlawful contact and communication with foreign countries and terrorist organizations vary according to the goals intended by the intelligence or the courier. This unlawful communication may aim to cooperate with the foreign country in order to obtain money or political asylum, or to avenge the regime in the country of the collaborator by carrying out terrorist operations , Or for any other reason. Some of the intelligence agencies of these countries or even terrorist organizations may succeed in recruiting some individuals, whether they are citizens or residents of other countries or even affiliated with the state in the service of their favor, or the terrorist organization to achieve intelligence, military, or terrorist goals. Also, unlawful contact with some countries may be made by some individuals at certain times, such as times of war, to harm the military operations of the target country, or it may take place in times of peace or war as well with the aim of harming its political, diplomatic, economic, or other position by cooperating with it commercially, medialy, or Politically or otherwise.
