الملخص
الملخص: مبدأ الموازنة بين أطراف الخصومة الجزائية يقتضي إتاحة فرص الدفاع عن مصالح الخصوم والمساواة بينهم في محاكمة علنية وحيادية، تستلزم معاملتهم معاملة متكافئة وفق متطلبات الشرعية الإجرائية المتضمنة قواعد إجرائية تهدف إلى تطبيق القانون الجنائي على نحو عادل، وما يتضمنه من ضمانات تجسد التوازن بين حقوق الادعاء العام، و الحقوق والحريات للأفراد في شتى مراحل الدعوى الجزائية، وفي مختلف درجات التقاضي. Abstract: The principle of balancing between the parties to the criminal litigation requires providing opportunities to defend the interests of the litigants and to equate them in a publicand impartial trial, whose treatment requires equal treatment in accordance with the requirements of procedural legitimacy which includes procedural rules aimed at applying the criminal law in a fair manner, and the guarantees it embodies in a balance between the rights of the public prosecution And the rights and freedoms of individuals in all stages of the criminal case, and in the various levels of litigation.
