الحق المالي من حقوق الملكية الفكرية وإمكانية إرتباطه بنظام الوقف وفقا للشريعة الاسلامية.

الملخص
تعد حقوق الملكية الفكرية حقوقا من طابع خاص بالنظر لإشتمالها على كل من الشق المعنوي والذي يتعلق بالارتباط الشخصي المالك بحقوقه الذهنية ،وشق مالي يتجسد في حق الاحتكار والاستغلال و إيراد كل التصرفات القانونية التي يراها مالك الحق الفكري مناسبة له في ظل حماية قانونية مشددة. ويعد الجانب المالي لحقوق الفكرية قابلاً للتملك والانتقال ،فقابلية التقويم المالي والتبادل التجاري تعدد الأساس الذي يبني عليه جمهور الفقهاء تعريفهم للحقوق التي تصلح لنظام الوقف ،فبالرجوع للأهمية الاقتصادية لحقوق الملكية الفكرية نجدها أضحت تدر أرباحا تماثل أو تفوق ماتدره الأعيان الموقوفة طبقا للنظرية التقليدية للأوقاف، وهو ما يدعو الي تشجيع الاستعانة بالأوقاف الفكرية في شقها المالي تماشيا مع تغير المفاهيم الإقتصادية والمالية للعصر الحالي. ا Abstract: : Intellectual property rights are rights of a special nature in view of the fact that it includes both the moral part and that relates to the personal connection of the owner with his intellectual rights. and the financial aspect is embodied in the right to monopoly, exploitation and revenue, all legal actions that the owner of the intellectual right deems appropriate for him in light of strict legal protection,the financial aspect of intellectual rights is subject to ownership and transfer, the possibility of financial evaluation and trade exchange is the basis on which the majority of jurists build their definition of the rights that fit the waqf system,returning to the economic importance of intellectual property rights, we find that they are generating profits that are similar to or greater than that of the arrested individuals, according to the traditional theory of endowments.it works to encourage the use of intellectual endowments in their financial aspect, in line with the changing economic and financial concepts of the current era. .
