الملخص
ملخص: تتحدث هذه المقالة بإيجاز حول الفحوصات الطبية التي تتم لأولئك المشتبه بإصابتهم بفيروس كورونا فيروس كوفيد-19 المُستجد. حيث نظرت المحكمة العليا في الهند لدعاوى قضائية وطلبات بإجراء فحوصات طبية مجانية للمواطنين الهنود، لأنها مكلفة للغاية لا يطيقها المواطن الفقير. هذا ما جعل المحكمة تتعامل مع: أزمة اقتصادية، تداعيات صحية، حقائق اجتماعية، وأحداث متسارعة، مما حدى بها إلى تقرير مبادئ قضائية مستجدة في سرعة فائقة. هذه المقالة تعرض التطور الدراماتيكي للمبادئ التي أرستها المحكمة فيما يتعلق بـ "مجانية الفحص الطبي"، حيث تبين الأسس الواقعية التي اعتمدت عليها، والاعتراضات التي تم توجيهها لأحكام المحكمة، والتغيرات والضوابط التي طالت مبدأ مجانية الفحوصات، والحدود التي وصل إليها في تقرير مبدأ "العلاج المجاني". وينتهي البحث إلى أهمية دور الحكومة في إجراء هذه الفحوصات الطبية، بسبب عدم قدره القطاع الخاص على تغطيتها بالمجان. كلمات مفتاحية: فيروس كورونا، الدستور، المحكمة العليا، الهند. Abstract: This article briefly talks about medical tests done for those suspected of having the Coronavirus-Covid-19. As the Supreme Court of India listened to lawsuits and requests for free medical tests of Indian citizens, because it is too expensive for the poor citizen. The court dealt with: economic crisis, health repercussions, social facts, and accelerated events, which led it to determine new and emerging judicial principles at a high speed. This article presents the dramatic development of the principles which established by the court with regard to the "free medical tests", as it shows the realistic foundations on which it relied, the objections that were directed to the court rulings, the changes and restrictions that affected the principle of free tests, and the extent to which the court has reached to establish a principle "Free treatment". The article concludes with the importance of the government's role in conducting these medical tests, due to the inability of the private sector to cover them for free.
