المسؤولية الجزائية للمنشآت المصنفة عن جرائم تلويث البيئة

الملخص
إن موضوع حماية البيئة من كافة أشكال التلوث الناجمة عن نشاط واستغلال المنشآت المصنفة من المواضيع التي تلقى اهتماماً بالغاً من قبل الباحثين في مجال الدراسات القانونية، بالنظر إلى الجرائم البيئية التي ترتكب من قبل هذه المنشآت باعتبارها كشخص معنوي، لأن في الكثير من الأحيان تؤدي الأنشطة الممارسة من قبلها إلى حدوث أضرار جسيمة وبالغة الخطورة يصعب تداركها أو معالجتها، كما تمثل انتهاكاً لحق الإنسان في العيش ببيئة نظيفة وخالية من الملوثات. وعلى هذا الأساس وإدراكاً من المشرع الجزائري لأهمية هذه الجرائم ومن أجل ردع المخالف أي المنشآت المصنفة لجأ إلى إصدار العديد من التشريعات في هذا المجال من خلال تنظيم استغلال هذه المنشآت، وتوقيع المسؤولية الجزائية على المنشآت المصنفة في حال مخالفة القوانين والتنظيمات البيئية، وذلك في إطار الموازنة بين متطلبات التنمية الاقتصادية ومتطلبات حماية البيئة حيث أضحى كل اعتداء على البيئة بفعل المنشأة المصنفة يعتبر جريمة تلويث البيئة. كلمات مفتاحية: المنشأة المصنفة، التصنيف، المسؤولية الجزائية، العقوبات Abstract: The topic of protecting the environment from all forms of pollution resulting from the activity and exploitation of the classified establishments is one of the topics that receives great attention by researchers in the field of legal studies, in view of environmental crimes committed by these establishments as being a legal person, because in many cases the activities performed From before it to the occurrence of severe and extremely dangerous damage that is difficult to prevent or treat, as it violates the human right to live in a clean environment free from pollutants. On this basis, and in recognition of the Algerian legislator of the importance of these crimes, and in order to deter the violator. the classified establishments, he resorted to issuing many legislations in this field by regulating the exploitation of these facilities, and signing criminal responsibility for the classified facilities in case of violating environmental laws and regulations, within the framework of the budget Among the requirements of economic development and the requirements of environmental protection, where every aggression against the environment by the classified facility became a crime of polluting the environment.
