الملخص
ملخص: أسهمت الثورة التكنولوجيّة والمعلوماتيّة التي شهدها العالم مطلع الألفيّة الثالثة إلى تغيير الكثير من المفاهيم وبروز العديد من الأنماط الجديدة في التعامل الالكتروني، ولعلّ من بين تلك المعاملات الجديدة التي ظهرت مع شبكة الانترنت هي المبادلات التجاريّة أو ما أصطلح عليه بالتجارة الالكترونيّة، تلك التجارة الإلكترونيّة والتي تُعتبر من أبرز مظاهر استفادة الإنسان من شبكة الانترنت، تقوم على عرض السلع والخدمات عن طريق الأجهزة الالكترونيّة وقيام الفرد بالتسوّق واقتناء مستلزماته من الانترنت دون حتّى التحرّك من مكانه مع ضمان وُصولها إليه، فلا يحتاج منك الأمر إلاّ جهاز إلكتروني ذكي مع توصيله بشبكة الانترنت لتتسوق عبر العالم شرقاً وغرباً شمالاً وجنوباً وتطلب أي سلعة تُريدها أو توفير أي خدمات ترغب فيها. هذا التطوّر الرهيب في المبادلات عبر الشبكة العنكبوتيّة نتج عنه ظهور عدّة مفاهيم جديدة تُنظمّ المعاملات التجاريّة مثل التعاقد والتوقيع الالكترونيين وكذا الدفع الالكتروني، فهي مفاهيم تخص التجارة التقليديّة تمّ تكييفها مع التطوّر الحاصل وإعطائها الصبغة الالكترونيّة، إلاّ أنّ التجارة الالكترونيّة هي الأخرى لم تسلم من المظاهر السلبيّة المرافقة للتجارة التقليديّة كالنصب والتحايل والغش والتدليس مع وجود فارق بينهما يتمثّل في كون التجارة الالكترونيّة تتم فيها المعاملات التجارية بين أشخاص مُفترضين لا تربط بينهم إلاّ شبكة الانترنت، لهذا سعى المشرّع الجزائري ومن ورائه التشريع المقارن إلى صياغة أحكام جديدة تكفل حماية ذلك النوع من التجارة من خلال تجريم كل مساس بقيمة العقد والتوقيع الالكترونيين مع حفظ وسائل الدفع الالكتروني من الاستغلال السيئ. Abstract: The technological and informational revolution witnessed by the world at the beginning of the third millennium has contributed to changing many concepts and the emergence of many new types of electronic transactions. Among these new transactions that emerged with the Internet are trade exchanges or what is referred to as electronic commerce, One of the most prominent aspects of human use of the Internet, based on the offer of goods and services through electronic devices and the individual shopping and acquisition of the requirements of the Internet without even moving from place with the guarantee of access to it, You only need a smart electronic device connected to the Internet to shop across the world east and west, north and south, and order any commodity you want or provide any services you want. This terrible development in the exchanges over the web resulted in the emergence of several new concepts that regulate business transactions such as electronic contracting and signing as well as electronic payment. They are concepts related to traditional trade that have been adapted to the development and give it an electronic character. However, electronic commerce is also not immune to the negative aspects Accompanying traditional trade such as fraud, fraud, fraud and fraud, with the difference between them is that electronic commerce transactions are carried out between the supposed people do not connect them only the Internet, so sought legislator Algeria And the comparative legislation to formulate new provisions that guarantee the protection of this type of trade by criminalizing any harm to the value of electronic contracts and signatures while preserving electronic means of payment from bad exploitation.
