المسؤولية التقصيرية لمنتجي النفايات الطبية

الملخص
ملخص: تتميز نفايات النشاطات الطبية عن غيرها من النفايات الأخرى بطابع الخطورة نظرا لتركيبتها الخاصة كونها تحتوي مواد ضارة، الأمر الذي يقضي التعامل معها بأقصى درجات من الحيطة والحذر خاصة من طرف منتجيها. عليه يتحمل منتجي النفايات الطبية المسؤولية القانونية عن المعالجة غير الآمنة في طرق التعامل مع النفايات الطبية والتخلص منها، لما تلحقه من أضرار تطال البيئة من جهة وصحة الإنسان من جهة أخرى، هذا ماجعل المشرع الجزائري يتصدى بتقييد نشاطات وخدمات المؤسسات الطبية والعلاجية المنتجة للنفايات الطبية بمجموعة من الإلتزامات والضمانات الواجب إتخاذها في عملية تسيير، مراقبة ومعالجة هذه الأخيرة. خاصة تلك المتعلقة بقيام المسؤولية التقصيرية في التعويض عن الأضرار التي تلحق البيئة، ومنه البحث عن مدى كفاية الأسس التي يمكن معها التعويض والتي تتماشى مع خصوصيتها بين أسس تقليدية وأخرى حديثة. Abstract: The medical activities wastes are distinct from other wastes by from other wastes by their hazardous nature, due to their special composition because they contain harmful substances, which require dealing with them with the utmost care, especially by their producers. Thus, the Medical waste producers bear the legal responsibility for the unsafe handling in the methods of dealing with medical wastes and their disposal, because of the damage they cause to the environment on the one hand and the human health on the other. This what led the Algerian legislator to restrict the activities and services of medical and therapeutic institutions producing medical waste; with a set of obligations and guarantees to be followed in the process of managing, monitoring and treating this latter. especially those relating to liability for compensation for damage to the environment, including the search for the adequacy of the foundations that can be compensated, which are in line with their privacy between the traditional and the other modern foundations.
