الركن المعنوي في جرائم الأعمال بين افتراض الادانة وقرينة البراءة.

الملخص
إن الركن المعنوي في الجريمة ركن أساسي لا يمكن أن تتكون قانونا دونه، إلا إذا ورد نص صريح يُعبر عن نية المشرع في إقصائه. إلّا أن الركن المعنوي في إطار جرائم الأعمال لم يبق محافظا على معاييره الأصولية، بل أضحى يتميز بالضعف، وذلك لاستبعاد الخطأ في جرائم الأعمال، إلى أن تم الاستغناء عنه كليا بتكريس الصفة المادية للجريمة. وقد تظهر كمبدأ عام قرينة البراءة في القانون الجنائي للأعمال، لكن القانون و/أو أحكام القضاء يمكن أن يتعارضان مع هذه القرينة من خلال إصدار قرائن معاكسة يمكن التصدي لها إلى حد كبير من خلال إثبات حسن النية. L’élément moral du crime est très indispensable d’une manière légale, et cela dans le cas ou il existe un texte explicite qui exprime l’intention du législateur à son exclure. Cependant, l'élément moral dans le cadre des infractions d’affaires ne tient pas à ses normes originales du fait qu’il se caractérise en faiblesse tout en éloignant la faute dans ce genre de crime jusqu’à ce soie complètement supprimé, en imposant son caractère matériel. La présomption d'innocence en droit pénal des affaires peut apparaître comme un principe général, tout de même la loi et / ou la jurisprudence peuvent se contredire avec cette présomption et ce en introduisant des présomptions contradictoires fondées avec une bonne foi. the moral element of the crime is very essential in a legal way and that in the case where there is an explicit text which expresses the intention of the legislator to exclude it. However, the moral element in the context of business offenses does not hold to its original standards because it is characterized by weakness while removing the fault in this kind of crime until it is completely suppressed, by imposing its material character. The presumption of innocence in the criminal law can appear as a general principal. However, this law and or the judiciary judgments may be contradictory to this presumption within the introduction of some other hypothesizes formed with a good intention.
