مدى ارتباط موانع الزواج بالنظام العام في ظل قانون الأسرة الجزائري

الملخص
إن تطبيقات فكرة النظام العام كثيرة سواء في مجال فروع القانون العام أو فروع القانون الخاص، ومن بين مواضيع الأسرة التي لها ارتباط وثيق بفكرة النظام العام في قانون الأسرة الجزائري هو موانع الزواج. فقد نص المشرع الجزائري في قانون الأسرة على موانع مؤبدة وموانع مؤقتة للزواج ورتب البطلان حالة مخالفة هذه الموانع، والبطلان هو أهم ما يميز فكرة النظام العام. ولعل ارتباط الموانع المؤبدة والموانع المؤقتة للزواج بفكرة النظام العام أمر بديهي، وذلك لارتباطها بالأسرة السليمة البناء التي يقوم عليها المجتمع. Les implémentations de l'idée de l’ordre public sont multiples, tant dans le domaine des branches de droit public que celui des branches de droit privé, et parmi les sujets familiaux tendrement liés à l'idée d'ordre public dans le droit de la famille Algérien se trouvent les empêchements au mariage. Le législateur Algérien stipule dans le droit de la famille des empêchements permanents et temporaires au mariage, ainsi qu’il trie d'annulation du mariage comme un cas opposé à ces empêchements. L’annulation du mariage est la caractéristique la plus importante de l'idée d'ordre public. La liaison des barrières permanentes et temporaires au mariage avec l'idée d'ordre public est peut-être intuitive, en raison de son lien étroit avec la famille saine sur laquelle repose la société. There are many implementations of the idea of public order, both in the field of branches of public law and that of branches of private law, and among family matters tenderly linked to the idea of public order in the law of the Algerian family are the obstacles to marriage. The Algerian legislator stipulates in family law permanent and temporary obstacles to marriage, as well as classifies annulment of marriage as a case opposed to these obstacles. The annulment of marriage is the most important feature of the idea of public order. The connection of permanent and temporary barriers to marriage with the idea of public order is perhaps intuitive, due to its close connection to the healthy family upon which society relies.
